Why is having a licensed
contractor so important ?
The use of an unlicensed contractor often leads to unsafe
and hazardous construction and additional cost to the
consumer. Here are some hazards associated with the hiring
of an unlicensed contractor:
Failure to meet the Florida Building Code
Standards – Unlicensed contractors are unable to
apply for a building permit, therefore their construction
work cannot be reviewed or inspected according to the
Florida Building Code—the statewide unified building
code system. Failure to meet the requirements of the
Code can result in unsafe and hazardous conditions.
Substandard Workmanship – Unlicensed contractors
have not demonstrated necessary competence through
training, experience and examination as required for licensed
contractors. As a consequence, unlicensed contractors may
be unaware of building code requirements and accepted
building practices.
Cost to Consumer – The work of an unlicensed contractor
is often substandard and ultimately leads to costly repairs and
corrections that require the services of a licensed contractor.
Therefore, the consumer may pay more for a job than if they
had initially hired a licensed contractor.
Fines – The hiring of unlicensed contractors violates
Chapter 10 of the County Code and Florida Statute Chapter
489. This may subject the consumer to violations on their
property and the possibility of fines.

Contracts performed by unlicensed contractors are
unenforceable (Chapter 489.128, Florida Statutes).
As a matter of public policy, contracts entered into on or
after Oct. 1, 1990, and performed in full or in part by
any contractor who fails to obtain or maintain a license
in accordance with this part shall be unenforceable in
law or in equity. However, in the event the contractor
obtains or reinstates his/her license, the provisions of this
section shall no longer apply. “Pursuant to Florida State
Statute above, any contracts entered into with unlicensed
contractors are unenforceable.” The Construction Lien
Law (Chapter 713, Florida Statutes) allows a contractor,
subcontractor, material supplier, or anyone providing
construction or material services to your home or
business, to place a lien against your property if they
are not paid for services or supplies. You can protect
yourself by asking your contractor for a statement that
all material suppliers and sub-contractors have been paid.

Roof Inspections

January 23rd, 2013

Our roof inspectors are available 24 hours a day to search for both necessary roof repair work and for conditions which might causea roof leak in the future. We produce a written report with pictures, High Definition video, and detailed notes upon the completion of every roof inspection. Our reports indicate to the homeowner, (or homebuyer, home seller and their real estate agents) what is needed. All of our roof inspections include the detail and professional opinion (typically missing from home inspection reports) that is needed by mortgage lenders, homeowners insurance adjusters and roof riders on home warranty insurance policies.

Roof Inspection

Have your client obtain a Leak-FREE Roof Certification from Timothy Parks Construction, Inc. to help with negotiations while relieving both you and your client from disclosure risk. Did you know that roof leaks are the number one source of claims against home inspection reports and that the consequential damages can cost thousands of dollars?
If you are worried that the age or appearance of the roof might put off potential buyers or complicate negotiations, certifying the roof can really help. It’s sure a lot cheaper than recovering the roof.

Our Leak-FREE Roof Certification is a binding, transferrable service agreement providing potentials buyers with professional assurance that the roof will do its job for at least one more year. Before the roof can be certified, it must pass our patent-pending rooftop inspection process. If the roof fails inspection, we will discuss our findings and necessary repairs providing a detailed report including digital photographs and High Definition video. Your client – or the buyer – will have all the information they need to move forward. The easiest thing to do, of course, is to have Timothy Parks Construction, Inc. perform the repairs and issue the certificate.

If you think the home inspection has this covered, think again. In order to avoid claims against their E&O coverage, most home inspectors include language in their reports deferring the opinion on the roof via a recommendation to bring in a roofing professional. When the home inspector excludes the roof, the disclosure liability falls back on the seller and you – the listing agent.
